Also, apparently there are only 3 grounds for further appeal and they all relate to procedural flaws, and not the merits of the case:

Challenge to Confirmation of CPO
3.74 In general terms, a challenge can be on one or more of three grounds:
• That the powers granted are “ultra vires”. This means they go beyond the powers permitted by the Act of Parliament under which they are being sought.
• That the procedural rules have not been followed correctly.
• That the Minister or the Inspector has not acted properly in reaching a decision – for example that there was no evidence to support the decision, or that irrelevant considerations were taken into account or relevant ones ignored.

The letter is fascinating because it talks about the "fine balance" which the Minister had to get right, plus no end of legal argument. No wonder it took so long. Let's hope this IS the end of it.

Sorry to aska a dumb question but this has been dragging on for so long its easy to forget things: do we have planning permission for the stadium part of the development yet or not?

Yes, but there are rumors that we want to change it to such a degree we might need to resubmit.

Still the possibility that Archway will appeal.

Still the possibility, if rumours about a significant redesign are to be believed, that we will need to seek new planning consent.

Hope so, the last design is too similar to the Emirates for my liking. It's 2014 now, that design is 10 years out of date.

:) I was talking to a Chelsea-supporting colleague about the new stadium recently and he admitted he is concerned they will be left behind.

Am getting to the point where I'm not that bothered with the design - we just need the bloody thing built and the income from the extra 20k seats. The risk of further unknown delays from amended planning permission is not attractive at all

This is the ground we're going to be playing at for the next 118 years (if the longevity of WHL is anything to go by).

You want to compromise the quality of that for the sake of a few weeks extra planning procedure?

It's more than rumours. We've appointed a completely different architect since the plans were originally submitted in 2009.

Yeah, I noticed that one too billy. Not sure what that means exactly, I thought this was the final step of the CPO.

Could just mean that there's paperwork and red tape in between now and the finished process, but might there be more to it? Chances for appeals etc?

The interesting bit in the details is that the Planning Inspector wanted to refuse the CPO because of the waiving of the affordable housing S106 after the riots, but Pickles fought to overturn that and grant the CPO.

This was also referred to elsewhere in this thread:

“Can you say why the development for Spurs, which is currently with the department on CPO, has been with the department for 14 months, might you reach a decision shortly and can you confirm (Mr Pickles) is in fact not an Arsenal supporter?”

Planning Minister Nick Boles responded to the MP by saying: “I would never dare tread into the question of people’s football loyalties, particularly not at this time.

“I do understand your frustrations on this. It hasn’t entirely always been with the department because we have had to refer back to parties on some very complex questions.

“I am keen to make a decision as soon as possible but I know you will want that decision to be a decision that holds up in court and therefore it is important to make sure it’s robust.”

It was very easy to become impatient with Pickles, though the months he has sat on this is still small fraction of the total wait since this was announced. But maybe part of this time has been actually to make sure it's done properly and in the long run will save us a lot of frustration and heartache?

I like the way the OS says the design has been future proofed in the intervening period, must mean it's capable of being extended at a later date. That's the first I've seen written anywhere that this will be possible.

Might be a reference to it being convertible to safe standing. Or just that it'll have more than 5 women's toilets.

Probably not a Gooner after all then.
Just trying to make it watertight if he's going against the Inspector's recommendation to turn us/the Council down.
It seems clear that Archway's solicitors were digging up all sorts of reasons that took time to carefully consider the response to.

This seems like it could be on the way to great news

Sadly, Harry Hotspur is saying that Archway will appeal. Which no doubt pleases him to see it dragged on even longer; he appears to have friends on the Archway side of things and said sometime ago that he'd be spilling details about what's gone on.

I'm sure it will all be fascinating. And unbiased.

They have no place even being in the stadium unless they are working serving me tea or burgers.
