Even if they do, anyone with standing can claim a government action (or inaction) is unconstitutional. If the SC cares enough then they'll take the case and rule.

If they do flip the seats then there will be SC judges all around. The more the merrier.

Also hearing Warren for Treasury might be on the cards. Lovely.

I'm not convinced at how large they can make the SC without losing a lot of middle ground they've clearly won recently.

The GOP stole a seat back at the end of Obama's time, but the rest were admitted as per the rules (even if they were ridiculous choices). Currently the Democrats are the party of democracy - they don't want to lose that in 4 years.

If they lose in 4 years it won't be because of that. In fact it may be that they win because of that. The voting rights act will be reintroduced and that will level the playing field somewhat. This plays into democratic hands as the demographics are shifting away from the white minority. Maybe even the electoral college will finally get the heave-ho if they get enough states to agree. Or maybe some good brick might happen to Americans and they might like it.

The appeasement approach to the moderate white diner dude has the country teetering on the brink of autocracy. This is not working. When one team is playing by the rules and one is not then simply taking the moral higher ground will not get you very far, and recent history shows this clearly. Anyway, the GOP has been stacking courts for years so the precedent has already been set.

There aren't any rules, there is a modern convention but the Republicans have thrown out loads of those. I think that it is similar to the Tories trying to load the Lords here, it doesn't really cut through outside a small group of politicos.

I think that this is a distraction though, it is a big ask for the Dems to win both Senate runoffs and even then they have a tied Senate and VP casting vote. I think that they needed a clear majority to make it a reasonable option.
