Abhorrent. The shooters (who were probably 'very fine people') have never been charged and this is only gaining traction now the eyewitness video has been released.

Alongside this, the complete disparity between how the NYPD are currently treating people in black neighbourhoods (violence and aggression, arrests and jail-time) to large congregations of white people in city parks (handing out gloves and masks, no action taken at all) is playing out with no word from the mainstream media. I watched this vid yesterday almost by accident, not realising what it was. Horrific. A modern-day lynching and it would have been buried except for the video, as you say.

edit: I'm reading the police had this vid the day after the incident.

Yes and I read that, the police had the footage and still decided not to do anything.
 
The police knew the guy in the back of the pickup, worked with him in the past or something.

He wasn't running at them, he was jogging on the road. It doesn't matter either way. They stopped the truck in the middle of the road ahead of him. The video is apparently shot by another man who can be heard roostering a gun whilst taking the footage. Turns out he is a friend of the two men in the truck. They were cornering him. You can see the video should you choose to on the pinned tweet of Shaun King's profile (Warning; it shows him being shot)

This happened two months ago and yet only because of a HUGE drive by citizens in relentlessly calling the FBI and police, petitioning and spreading awareness have the men been charged. This happened in the last couple of days as a result of the video being shared.
 
If a redneck with a shotgun approached me in a pickup truck when I was out jogging, claiming he just wanted "to talk to me", I'd be terrified too. Self defence my ass.

I didn't know he was running from the truck behind. All I've read says he was running away from the truck in front.

Which makes running towards it unusual at least.

I don't think he was aware of the truck behind, or running away from the truck in front. He was literally jogging on the road.
 
I read he had been previously avoided them on different roads but they 'caught' him.

Ah, ok. The reports I'd read sounded like they'd already tried to get him to stop and he was running from them. Hence why it seemed so strange to head towards them.

Surely he has some culpability too.
 
I guess the exact circumstances will come out in time but to be frank, the lead up doesn't really matter. The man was out for a jog and was executed.
According to his aunt, he was the one intruding in the house under construction. There's a few sites that reference her seeing the video and admitting it was him. Plenty that don't mention it at all though - one of those emotive subjects where facts are very hard to ascertain.

If it was him, this case is likely to land one way or the other on a technicality of the break in. This is going to get a little law geeky, so strap in.

In Georgia, a citizen's arrest is valid if the crime being commited is a felony. You are allowed to pursue and detain a suspect awaiting the police. Breaking and Entering is not a felony, Burglary is. The difference between the two is stealing or intent to steal as a part of the B&E. So if the defendants can show an intent to steal then they have demonstrated they had the right to pursue and detain a suspect.

Georgia is not a full open carry state, but you can open carry with a state license - the fact that the defendants were not immediately charged with carrying weapons leads me to believe that they probably had the relevant licenses. Plus they're rednecks so they probably carry all the time. So they can also demonstrate that they were within their legal rights to have their guns with them.

In terms of the shooting itself, thing are a little unclear. If statements from the defendants/their friend in the truck behind and the video we've all seen is the totality of the evidence, it's not an easy prosecution to win. The "action" starts behind the truck - the defendants will almost certainly claim that Arbery attacked them and tried to take the gun off of the one out of the truck. It's an unlikely event, but let's not forget that the standard is "proof beyond reasonable doubt" and they only need one juror to have enough doubt.

Georgia also has the "Stand your ground" self defence statute. This means that anyone being attacked is able to use force (potentially unlimited force) to defend themselves. If the defendants can convince the jury of the paragraph above, then they pass this test fairly easily.

So what it will likely boil down to is whether or not an intent to steal can be shown, as everything else will hinge on that.

Please note, this is not a moral judgement on the case, simply an explanation of why it will not be easy to convict - especially in front of a jury in Georgia.
