The 4th spot can still be lost if both CL and EL are won by teams that don't finish top four. So its not technically safe until City and Arsenal are out or Liverpool and Utd are out.

I thought that was changed the season or so after we were "cheated"?

Yes it was changed. If an English team wins the CL, fourth is protected as we get five teams if necessary. But now the EL winner gets a CL berth and if that team is English we can also get five teams. However, if English teams win both CL and EL, then we still only get five teams and 4th misses out. It seems such an improbably event that I wonder why they bothered about the rule ... if not to worry Spurs fans.
