Surely there would be a way around this anyway, you would just make it so the offending comments can be posted but, you would only be able to see them if you are a member of the forum thereby making the comments in essence 'private' and therefore not a public publishing of those comments/views, similar to the difference between a facebook chat and a facebook status update or a phone call and addressing a radio station via phone.
