Anton says he didn't hear it and didn't find out until after the game. It was someone in the crowd (an off-duty policeman?) who reported it to the police and then they had to take action.

Terry's story is what got him acquitted in the criminal court. He could deny he uttered the words, so he needed an explanation that couldn't be disproved. It obviously worked as the judge said the evidence wasn't clear so he could rile out Terry's explanation. Terry's lawyer probably made sure he didn't directly ask him if it was true. The irony is that if Terry followed the demands he apologise then he risks proving that he perjured himself.

The fines and ban are set out in the rule book and the two charges are very specific. The FA can't just make up some fine and penalty. The FA penalty is a lot stiffer than the legal one would have been. If Terry had been found guilty in the criminal case he would have had a maximum fine of £2500.

Right, I might be coming across as a bit thick here and I'm probably labouring the point a bit but bear with me please, how can Terry base his defence on answering a question that he was never asked? Surely if AF is asked if he asked the question of JT and says no then how can JT claim to have been repeating the question back? I'm sure cleverer men than me wouldn't have let that opportunity go by in court.

Well, my simple explanation is he made it up and no one can prove he didn't. Its Terry's word against Anton's. That is enough doubt to prevent a beyond reasonable doubt verdict in a criminal trial. The judge said it seemed unlikely but without other witnesses he couldn't rule it out.

Its hard to prove something that didn't happen didn't happen. You need good accounts of what happened to disprove it. With Terry and Anton shouting abuse at each other like a couple of children and only Ashley Cole around as "independent" witness, confusion wins out.

Interesting stuff, read first few pages and it's pretty interesting... explains how Terry was bricking it a bit in the changing room so called Ferdinand in to try and worm his way out of it but was then pretty relieved when Ferdinand said he hadn't heard any racist bit.. bet Terry thought he had got away with it til after the game when it was all over youtube lol!

"We have watched the film footage many times. In the critical phase, during which he uses the words, Mr Terry can be seen to be smiling initially, before his facial expression changes to disdainful and contemptuous.

"At no point is his demeanour and facial expression that of someone who is imploring, injured, or even quizzical in the face of an unfounded allegation by Mr Ferdinand that he had just been racially abusive towards him.

"Anger is a conceivable reaction to such an accusation, but at no time does Mr. Terry convey any sense of 'no, I didn't‟t' with his facial expression, or body language."

The report adds: "In the light of those findings, the commission is quite satisfied, on the balance of probabilities, that there is no credible basis for Mr Terry's defence that his use of the words were directed at Ferdinand by way of forceful rejection and/or inquiry.

"Instead, we are quite satisfied, and find on the balance of probabilities, that the offending words were said by way of insult."

Nowhere in that statement is he labelled a 'racist'

If I've missed it - feel free to point it out.

I'm not speaking about what he is or not in reality - simply addressing the legal aspect of matters. I've seen countless threads pulled over the years for less, better yet some posts recently (GB - much to my surprise)

Sweet.. Personally don't see him appealing, he will get 8 games if he does IMO.

Given he has been charged in a criminal court and found guilty of FA charges of using insults with race related wording, its a legitimate question.
